PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of Writ of Certiorarified Mandamus, to call for the records relating to the proceedings in Ref.No.E1/2988/2003 dated 19.6.2003 passed by Arasu Rubber Corporation Limited, Vadaseri, Nagercoil-629 001 (the first respondent herein) and to quash the same and direct the respondents herein to consider the name of the petitioner for filling up the vacancy to the post of Vigilance Officer in the first respondent Corporation.

What is under challenge is communication dated 19.06.2003 issued by the Chairman-cum-Managing Director of the Arasu Rubber Corporation Limited (Company) rejecting the request of the petitioner for amendment of the Service Rules of the Company and consequently a direction to appoint the petitioner, who is a Field Assistant, as Vigilance Officer in the said company.

2.Mr.Subbiah, learned Senior Counsel appearing for learned counsel for the petitioner on record would fairly state that there is no specific flaw or lacuna in the Service Rules of the company. The direction for appointment of the petitioner as vigilance officer does not survive any more insofar as the petitioner has, pending writ petition, superannuated. He draws my attention to the appointment of the Vigilance Officers of the company for the period 1984 till date and specifically to some instances of delay in appointment of the Vigilance Officer, during the period 1984 and 1994. Thereafter, however, appointments to the post of Vigilance Officer appear to have been made more or less promptly and in a timely manner.
3. In such circumstances, this Writ Petition is liable to be dismissed as I do so. No costs.
