issue a Writ of Certiorarified Mandamus calling for the records of the third respondent in connection with the impugned order passed by him in P19/2/11916585/ADK/816 dated 16.07.2019 and the consequential order passed by the second respondent in his proceedings C.No.Estt.I(2)SB 632/9194/2019 DO No.1099/SB/2019 dated 16.09.2019 and the recovery order issued by the fourth respondent in Rc.No.B2/288/11524/2019 DO No.SB 244/2020 dated 03.03.2020 and quash the same and further direct the respondents to revise the salary of the petitioner drawn at the time of retirement as Rs.55,700/- at par with his batchmates and order reimbursement of the amount recovered from the retirement benefits of the petitioner within a reasonable time and further direct the respondents to revise the pension and other benefits accordingly, draw and disburse the same within a reasonable time frame.

The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus calling for the records of the third respondent in connection with the order in P19/2/11916585/ADK/816 dated 16.07.2019 and the consequential order passed by the second 2/6
respondent in his proceedings C.No.Estt.I(2)SB 632/9194/2019 DO No.1099/SB/2019 dated 16.09.2019 and the recovery order issued by the fourth respondent in Rc.No.B2/288/11524/2019 DO No.SB 244/2020 dated 03.03.2020 and quash the same and further direct the respondents to revise the salary of the petitioner drawn at the time of retirement as Rs.55,700/- at par with his batchmates and order reimbursement of the amount recovered from the retirement benefits of the petitioner within a reasonable time and further direct the respondents to revise the pension and other benefits accordingly, draw and disburse the same within a reasonable time frame. 2.
The learned Senior Counsel appearing for the petitioner submitted that the petitioner entered the service as directly recruited Grade - II PC (Armed Reserve) through a selection conducted by the Head of the Department and was appointed on 25.05.1988 and as thereafter upgraded as Grade - I PC on 28.09.1999 and was further upgraded as Head Constable with effect from 28.10.2004 and was further upgraded as Special Sub - Inspector in the year 2020 and was superannuated from service on 31.05.2019 while serving on deputation as Special Sub - Inspector in the Special Investigation Wing, Trichy under the control of SB CID.

3.The learned Senior Counsel appearing for the petitioner further submitted that when the petitioner was superannuated from service, he was drawing a basic scale of pay of Rs.55,700/- and the pension papers have been processed and sent to the third respondent for fixing the pension, however, the pension papers were returned by the third respondent vide order dated 16.07.2019 with an endorsement that fixing the salary of the petitioner as Grade - I PC as well as Head Constable is incorrect, thereby, the pay of the petitioner was revised by the second respondent vide order dated 16.09.2019 at Rs.54,700/-.
4.The learned Senior Counsel appearing for the petitioner further submitted that thereafter the petitioner made representation to the respondents seeking pay fixation on par with his batchmate Nagaraj, pursuant to which, the Superintendent of Police, Special Division CID, Chennai sent communication dated 27.10.2020 to the first respondent seeking orders for rectifying pay anomaly in respect of the petitioner on par with his batchmate M.Nagaraj, SSI, Special Division CID, Headquarters, Chennai, with effect from 01.04.2000, however, till date no order was passed by the first respondent. it would suffice, if this Court issue direction to the first respondent to pass appropriate orders as sought for in the second respondent's communication dated 27.10.2020.
5.Considering the limited relief now sought for by the learned Senior Counsel appearing for the petitioner, this Court without expressing any opinion on the merits of the case, directs the first respondent to pass appropriate orders as sought for by the Superintendent of Police, Special Division CID, Chennai vide communication dated 27.10.2020, by reconsidering the order passed by the second respondent dated 16.09.2019, within a period of twelve weeks from the date of receipt of a copy of this order. 6.The writ petition is disposed of on the above terms. No costs.
