No.22322/2018 in above A.S. for depositing the sum of Rs.2,00,000/- and the cost of Rs.49,381.50 i.e. in total Rs.2,49,381.50 to the credit of O.S.No.24/2015 on the file of the District Court, Karaikal by another period of 4 weeks from 31.01.2019 pending AS NO.845 of 2019.
Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.K.P.JOTHEESWARAN, Advocate for the petitioner and of MR.K.V.BABU Advocate on behalf of the Respondent the court made the following order:- This petition has been filed to extend the time by 4 weeks prescribed in the interim order of stay dated 19.12.2019 made in CMP.No.22322 of 2018 in Appeal Suit for depositing the sum of Rs.2,00,000/- and the cost of Rs.49,381.50 i.e., in total Rs.2,49,381.50 to the credit of O.S.No.24 of 2015 on th file of the District Court, Karaikal by another period of 4 weeks from 31.01.2019.
2.Earlier, this Court, by order dated 19.12.2018, granted interim stay on condition that the petitioners deposit a sum of Rs.2,00,000/-(Rupees Two Lakhs only) with costs to the credit of the suit in O.S.No.24 of 2015, on the file of the District Court, Karaikal within a period of four weeks from the date of receipt of copy of that order. Now, the present application has been filed to extend four weeks time to deposit the said amount. https://hcservices.ecourts.gov.in/hcservices/
3.Today, when the matter came up for hearing, the learned counsel appearing for the petitioners submitted that the petitioners are not able to mobilize the said amount within the time granted by this Court and hence he seeks to extend the time by four weeks to deposit the said amount.
4.The learned counsel appearing for the respondents has no serious objection to grant four more weeks time to deposit the said amount.
