Prayer: Contempt Petition filed under Section 11 of the Contempt of Courts Act for the non-compliance of the order dated 20.01.2011 passed by this Hon'ble Court in W.P.No.12762 of 2009.

O R D E R

The respondent/ contemnor filed an additional affidavit dated 03.01.2025, stating that the petitioners were granted permanency from different dates, as indicated in Paragraph No.1 of the additional affidavit. It is also further brought to the notice of this court that the respondents are ready to disburse the amounts as detailed in the annexures appended to the additional affidavit and thus, reported that the respondents are ready to comply with the order dated 20.01.2011 passed in W.P.No.12762 of 2009.

2. Mr.V.Prakash, learned Senior Counsel appearing for the petitioners, however, contended that though the petitioners were granted permanency from different dates, but consequential benefits have not been extended, and he is not sure about the amounts that are due and payable to the petitioner.

However, he submitted that the petitioners would receive the amounts as is mentioned in the annexures appended to the additional affidavit under protest and in case, if any further differential amounts are due, the petitioners may be granted liberty to make a claim under 33(C)(2) of the Industrial Disputes Act, 1947, including the consequential promotion, seniority etc.,

3. While granting liberty as sought for, the contempt petition is closed. The respondents are directed to release the amounts, as agreed, within a period of two weeks from today. No costs.
