Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Certiorarified Mandamus to call for the records in respect of impugned list dated 21.01.2025 of the candidates who have been provisionally admitted to physical certificate verification and oral test for the post of Deputy Manager (Accounts) included in Combined Technical Services Examination Notification No.7/2024 dated 15.05.2024 and quash the same with consequential direction to the respondent to permit the petitioner to participate in the physical certificate verification and oral test and also to select me for appointment based upon my eligibility. ORDER

The question involved in this case is the equivalence of the Degree Certificate given by the Anna University for the Degree in MBA (Finance and Human Resource Management) with that of the MBA (Finance). 2.It is the submission of the learned Senior Counsel appearing on behalf of the petitioner that in pursuance of the order of this Court, dated 31.01.2025, the petitioner has been given a Provisional Selection Letter. However, in view on the stalemate in deciding the equivalence between MBA (Finance) and MBA (Finance and Human Resource Management), no appointment order is given to the petitioner, and as a result of which, the present writ petition is pending.

3.In order to find resolution, this Court deems it appropriate to suo motu implead (i) the Member Secretary, Tamil Nadu State Council for Higher Education and (ii) the Principal Secretary, Tamil Nadu State Council for Higher Education as the party respondents R4 and R5. Mr.C.Jayaprakash, learned Government Advocate takes notice for the suo motu impleaded 3/6

respondents R4 and R5.

4.Since the petitioner has already been given Provisional Selection Letter, on the basis of the earlier order of this Court dated 31.01.2025, it is incumbent to decide, whether the Degree in MBA (Finance) is equivalent to MBA (Finance and Human Resource Management). In this connection, the petitioner has already given a request for Equivalence Certificate to the R4/the Member Secretary, Tamil Nadu State Council for Higher Education on 07.02.2025.

5.In such view of the same, this Court deems it appropriate to direct the 4th and 5th respondents to consider the petitioner's representation dated 07.02.2025 according to its own merits and in accordance with law and pass order within a period of two (2) weeks from the date of receipt of a copy of this order. It is made clear that the 1st respondent is at liberty to take further course of action either to affirm with the provisional selection list or negate the same, based on the out come of the Equivalence Committee Report. 4/6
