ORDER

The writ petition has been filed seeking a mandamus to the third respondent to conduct an enquiry in Na.Ka.No.25651/2025/E4 dated 22.11.2025 within a time frame fixed by this Court.

2. The petitioner grandparents are one T.P.Sellamuthu and Ponnammal. The said couple had seven children, of whom one Pandurangan is the father of the petitioner. The petitioner's great grandfather is Palani Boyan, who is none other than the father of Sellamuthu. The petitioner would submit that his forefathers had purchased certain properties and the same was inherited by him through his father Pandurangan, who is now deceased. According to the petitioner, the respondents 5 to 7 had created forged and fabricated documents namely "Vamsa Vazhi Varisu Sandhridhal" dated 08.03.1998 and "Nila Urimai Sandhirdhal" dated 16.02.2024, as if the said documents were issued by the 3rd respondent herein. By virtue of the aforestated documents, the respondents 5 to 7 had executed a sale in favour of respondents 8 and 9, on 09.09.2024.

3. The respondents 5 to 7 claim to be the legal heirs of one Ravi, whose father is one Myilsamy, who is also the son of Palani Boyan. In the "Vamsa Vazhi Varisu Sandhridhal" dated 08.03.1998, these respondents claim that T.P.Sellamuthu, S/o.Palani Boyan had died issueless.

The petitioner herein had submitted a representation to the fourth respondent on 23.09.2025 seeking to furnish a copy of the "Vamsa Vazhi Varisu Sandhridhal" dated 08.03.1998 and "Nila Urimai Sandhirdhal" dated 16.02.2024, alleged to have been issued by the third respondent. In reply, the fourth respondent vide his communication dated 25.10.2025 had stated that since the said documents were not issued in the Office of the third respondent. Thereafter, on 07.11.2025, the petitioner had submitted a representation to the 4th respondent requesting to conduct enquiry on the veracity of the said documents, with a copy marked to respondents 1 to 3.

5. In response, the first respondent, the District Collector, Tiruppur, vide his proceedings dated Na.Ka.No.25651/2025/E4 dated 21.11.2025, had directed the third respondent to conduct enquiry. However, the third respondent had not conducted the enquiry till date. Hence, the petitioner is before this Court to direct the third respondent to conduct an enquiry, based on the proceedings of the first respondent dated 21.11.2025.

6. Heard the learned counsel on either side and also perused the material records placed before this Court in the typed set of papers.

Considering the facts and circumstances of the case and also taking into account that despite the directions being issued by the District Collector, Tiruppur, the first respondent herein, to conduct enquiry on the petitioner's representation dated 07.11.2025, the third respondent has not acted on the same till date, therefore, a mandamus is issued to the third respondent to conduct an enquiry forthwith and pass orders after affording an opportunity of hearing to the petitioner as well as to the interested parties to the litigation. The entire exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order.
