Reliance General Insurance Company Ltd v. C.Arul

C.M.P.No.6867 of 2023 in C.M.A.SR.No.132875 of 2022 N.MALA.J., This Petition has been filed to condone the delay of 1582 days in filing the above Civil Miscellaneous appeal against the Judgment and Decree made in MCOP.No.682 of 2013 dated 28.02.2018 on the file of the Motor Accidents Claims Tribunal (Chief Judicial Magistrate, Coimbatore).

2. Heard the learned counsel for the Appellant/Insurance Company and Mr.Sharath Chandran, learned counsel for the 1st respondent.

3. The learned counsel for the appellant would submit that the 2nd respondent, driver of the vehicle and the 3rd respondent, owner of the vehicle had remained exparte in the Court below and notice may be dispensed with for the 2nd and 3rd respondents as no relief is claimed against them in the present appeal. The learned counsel has also made an endorsement to that effect.

4. The learned counsel for the 1st respondent fairly submits that he has no objection to the delay of 1582 days being condoned.

5. I have gone through the affidavit filed in support of the petition and I am satisfied with the reasons stated therein, therefore, the delay of 1582 days is condoned.

6. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the same for admission. https://www.mhc.tn.gov.in/judis 1/2

7. Registry is further directed to print the name of the learned counsel for the 1st respondent at the time of admission.
