WP.3162 of 2018 Prayer: The Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus to call for the entire records relating to the Notice dated 20.01.2018 issued w.r.t, the complaint in C.No.-G-1(2)/47365/ 5011/2017, C.No.179/DCB/VLR on the file of the second respondent herein and quash the same and consequently direct the respondents 1 and 2 herein refrain from coercing the petitioner herein to make payment towards the alleged loan said to have extended by the 3rd respondent herein in respect of which a Civil suit in O.S.No.10 of 2017 on the file of Additional District Judge, Ranipet for recovery of money is pending. JUDGMENT
(Delivered by M.M.SUNDRESH, J.) This appeal has been preferred against the order of the learned Single Judge, who while dismissing the writ petition, https://hcservices.ecourts.gov.in/hcservices/
directed the first respondent to complete the enquiry within a period of six weeks from the date of receipt of a copy of the order.
2. Heard Mr.V.R.Rajasekaran, the learned counsel appearing for the appellant, Mr.S.John J.Raja Singh, learned Government Counsel appearing for respondents 1 and 2 and Mr.J.Antony Jesus, learned counsel appearing for the third respondent.
3. Though the learned counsel appearing for the appellant submitted that the suit filed by the third respondent has been dismissed, inasmuch as the challenge has been made only to the memo issued to attend the enquiry, we do not find any error in the order passed by the learned Single Judge.
4. In such view of the matter, we call upon the second respondent to complete the enquiry within a period of six weeks from the date of receipt of a copy of this judgment. We make it clear that we have not expressed anything on the merits of the case.
5. The writ appeal stands disposed of accordingly. No costs. Consequently, the connected miscellaneous petition is closed.
