Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita/Section 482 Cr.P.C, to direct the learned District and Session Judge, Special Court for SC/ST Act cases, Thiruvannamalai District to consider the bail application of the petitioner filed by him on the same day of his surrender in Crime No.44 of 2025 on the file of the 2nd respondent police.

O R D E R
This criminal original petition has been filed seeking a direction to the learned District and Session Judge, Special Court for SC/ST Act cases, Thiruvannamalai District, to accept the surrender of the petitioner and to consequently, consider his bail petition on the same day, on merits, in connection with Crime No.44 of 2025 on the file of the 2nd respondent.
2. When the matter was taken up for hearing, the learned Government Advocate (Crl. Side) appearing for the respondents submitted that apart from the offences under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, the case has also been registered for the offence under Section 302 of IPC as against the petitioner.
3. In view of the above submission made by the learned Government Advocate (Crl. Side), this Court is of the view that the usual order directing consideration of the bail petition of the petitioner on the same day of his surrender cannot be granted and accordingly, this criminal original petition stands dismissed.
