Respondent Prayer: Writ petition filed under Article 226 of the Constitution of India, for the issuance of a Writ of Mandamus directing the Respondent to respond and consider the Petitioner's representation dated 10.01.2023 and also direct the Respondent to permit the Petitioner to participate in the Auction / Tender Sale of the assets/ materials equipment in the decommissioned Ennore Thermal Power Station pursuant to the notice dated 22.12.2022. O R D E R
The writ petition has been filed more out of an apprehension over a notice issued by the respondent on 22.12.2022. For some reason, the notice was restricted to be circulated in and around Chennai only.
2. The petitioner, was of the impression that the notice was to call for bids but it is clarified by the learned Standing Counsel for the respondent that the notice is only preliminary in nature seeking prospective bidders to give their valuation for the material which are to be put up for auction at a later date.
3. It is also stated that notice was actually an exercise in futility as nobody turned up to give their valuation.
4. It is also stated that the actual auction notice would be issued with vide publicity and in the E-Portal of the respondents and I am confident that if that is done, the petitioner would have every opportunity to participate in the E-Tender. The writ petition as on date has been filed as earlier stated more out of apprehension. 2/4
Apprehension need not rest in the mind of the petitioner herein. No further orders are required.
5. The writ petition stands disposed of. No costs. Consequently, WMP No.2640 of 2023 is closed.
