Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, to call for the records pertaining to the disqualification slip dated 29.11.2023 issued by the respondent and to quash the same and further direct the respondent to allow the petitioner to participate in the next phase of selection for the post of Sub Inspector of Police 2023.

ORDER

This writ petition has been filed calling for the records pertaining to the disqualification slip dated 29.11.2023 issued by the respondent and to quash the same and further direct the respondent to allow the petitioner to participate in the next phase of selection for the post of Sub Inspector of Police 2023.

2. There is no representation on behalf of the petitioner. Heard the learned Additional Advocate General appearing for the respondent and perused the materials available on record.

3. The petitioner is qualified with Master degree in M.A Journalism and Mass Communication. He had applied for the post of Sub Inspector as per the recruitment notification issued by the respondent. The selection process consist of written examination, physical test and viva-voce. He had cleared the written examination and was called for physical endurance test, to be held on 07.11.2023. Since the petitioner was severely affected by Dengu fever, he was unable to participate in the Physical Endurance Test. Therefore, the petitioner submitted a representation requesting to conduct the physical endurance test on some other date. Considering the request made by the petitioner, the selection committee re-scheduled the physical endurance test on 29.11.2023. On that date, the petitioner was present for the physical endurance test. However, he

was not fit enough to participate in the physical endurance test and as such, he asked for further time. Thereafter, he also failed to produce any certificates before the selection committee. Therefore, the respondent has no other option than to issue disqualification slip to the petitioner, thereby disqualified his candidature for selection to the post of Sub Inspector of Police, 2023.

4. It is seen that now the entire selection process has been completed and the respondent also published the selection list to the post of Sub Inspector of Police.

5. In view of the above, this writ petition is devoid of merits and is liable to be dismissed. Accordingly, this writ petition is dismissed. There shall be no order as to costs.
