The present Criminal Original Petition has been filed seeking to quash the proceedings pending against the petitioner in S.C.No.78 of 2025, pending on the file of the Mahila Court, Perambalur. 1/4

When the matter was taken up for hearing today, the learned Government Advocate (Criminal Side) submitted that LW1 has been examined as PW1 on 12.02.2026 and the case now stands posted for examination of LW2 to LW4 on 05.03.2026 and since the trial has already commenced, the proceedings cannot be quashed at this stage. 3.

Taking note of the facts of the case and the submissions made by the learned Government Advocate (Criminal Side) that the trial has already commenced in this matter, this Court is not inclined to interfere with the trial proceedings at this stage.

At this juncture, the learned counsel appearing for the petitioner sought the indulgence of this Court, to dispense with the personal appearance of the petitioner before the trial Court. 5.

Given the stage of the case which is sought to be quashed, the Criminal Original Petition stands dismissed. However, the personal appearance of the petitioner before the trial Court is dispensed with, except for receipt of copies, answering the charges, questioning under Section 313 2/4

Cr.P.C., passing of judgment, or any other date as may be required by the trial Court. It is made clear that the petitioner shall be duly represented by his counsel before the trial Court.

It is clarified that the petitioner shall appear before the trial Court if the trial Judge insists upon the presence of the petitioner for the purpose of identification and progress of the trial. 16.02.2026 ham To 1.
