ORDER
This writ petition has been filed to direct the respondent to issue patta in favour of the petitioners for the property morefully disclosed in the affidavit filed in support of this writ petition, within a time frame to be fixed by this Court.
2. The property for which patta is sought for is an estate property. The petitioners have filed supporting documents along with the petitioners' representation to the respondent. Since the representation of the petitioners was not considered by the respondent till date, the petitioners have filed this writ petition.
3. Till date, counter has not been filed by the respondent in this writ petition.
4. The learned Special Government Pleader appearing for the respondent would submit that the property for which patta is sought for is classified as Anadheenam land. However, the same is disputed by the learned counsel for the petitioners. Since counter has not been filed by the Page No.2 of 7
respondent till date, this Court is of the considered view that no prejudice would be caused to the respondent, if the petitioners' representation seeking for issuance of patta for the property morefully disclosed in the affidavit filed in support of this writ petition is considered on merits and in accordance with law, after giving due consideration to the supporting documents filed by the petitioners, within a time frame to be fixed by this Court.
5. The learned Special Government Pleader appearing for the respondent, on instructions, would submit that since the respondent is the Commissioner of Land Administration, it will take six months for the respondent to dispose of the petitioners' representation.
6. This Court is not expressing any opinion on the merits of the petitioners' representation.
7. Since the learned Special Government Pleader appearing for the respondent also submits that the petitioners will have to submit a fresh representation with the respondent, the learned counsel for the petitioners, Page No.3 of 7
on instructions, would submit that the petitioners are willing to submit a fresh representation.
8. For the foregoing reasons, this Court directs the petitioners to submit a fresh representation to the respondent seeking for issuance of patta for the property morefully disclosed in the affidavit filed in support of this writ petition, within a period of two (2) weeks from the date of receipt of a copy of this order. On receipt of the said representation within the stipulated time, the respondent shall pass final orders, on merits and in accordance with law, after giving due consideration to the supporting documents filed by the petitioners, within a period of six (6) months thereafter.
9. With the aforesaid directions, this Writ Petition is disposed of. There shall be no order as to costs.
