in Crl.OP.No.25685 of 2021 T.V.THAMILSELVI,J.

The present petition has been filed to modify one of the conditions imposed on the petitioner in Paragraph No.7 Clause (b) of the order in Crl.OP.No.25685 of 2021 dated 03.01.2022 while granting anticipatory bail.

2. The learned counsel for the petitioner submits that as per the earlier order, the petitioner is directed to deposit Rs.10,000/- as interim maintenance to the children and the amount may be deposited in the account of the minor children under the guardianship of the defacto complainant. Whereas, the guardian/defacto complainant of the minor child is not co-operating to open a bank account, hence, the petitioner has not complied with the order.

3. The learned Government Advocate (Crl.Side) has furnished the bank details of the father of the deceased/defacto complainant who is now the guardian for the minor child . The petitioner is directed to send interim maintenance as he agreed to the account of grand father of the minor child 1/3

namely Nagaraj until it is modified by the Court of Law and further more, the learned counsel for the petitioner submits that the petitioner also wanted to see the minor child. Admittedly, since the mother has committed suicide, the child is under the custody of maternal grand parents and the child is 12 months baby.

4. In view of the consent expressed by both parties, this Court shall refer the matter for Mediation Centre, Thiruvallur for the purpose of solving the dispute pending between the parties

5. Both the parties are directed to appear before the Mediation Centre for five sittings without fail and the first sitting shall commence on 23.03.2022.
