Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus or any other appropriate Writ, direction or order in the nature of a Writ, calling for the records of the second respondent relating to the order in herein in Na.Ka.No.R1/1515/2010, dated 30.06.2010 (served on 01.07.2010), quash the same to the limited extent insisting of production of Plus Two course Certificate instead of I.T.I certificate and issue consequential direction to 1/4

the second respondent to permit the petitioner to participate in the selection proceeding to the post of Sub-Inspector of Police for the year 2010, (Reg.No.1003598).

ORDER

This Writ Petition is filed challenging the order, dated 30.06.2010, whereby, the petitioner, who is only an I.T.I holder was precluded from participating in the selection of the post of Sub-Inspector of Police for the year 2010 as he was not in the possession of Higher Secondary Certificate.

2. When the matter came up for hearing today, the learned Government Advocate would submit that the selection has since been proceeded and was over in the year 2010 itself and the prayer in the Writ Petition has become infructuous.

3. On perusal of the counter affidavit also, it is seen that the selection is completed and the notification insisted upon Higher Secondary qualification by G.O.Ms.No.107, P&AR Department, dated 18.08.2009, 2/4

which is also upheld by the Division Bench of this Court by judgment, dated 10.02.2011 in W.P.No.18729 of 2010.

4. Therefore, the above Writ Petition is dismissed as having become infructuous. No costs.
