Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondents to sanction the annual increments to the petitioner with effect from the year 1991 taking into account the 4th, 5th and 6th Pay Commissions and to re fix the scale of pay of the petitioner and to pay the arrears of salary to the petitioner and pass appropriate orders on merits and in accordance with law.

ORDER

This writ petition has been filed seeking issuance of a mandamus directing the respondents to sanction the annual increments to the petitioner with effect from the year 1991 taking into account the 4th, 5th and 6th Pay Commissions and to re-fix the scale of pay and to also pay the arrears of salary to the petitioner.

2. Learned counsel for the petitioner submitted that after the petitioner was recruited as a Village Administrative Officer by the Tamil Nadu Public Service Commission in the year 1984, the Vigilance and AntiCorruption Department laid a trap on 15.10.90 and subsequently, he was placed under suspension. The order of suspension was questioned before the Tamil Nadu https://hcservices.ecourts.gov.in/hcservices/

Administrative Tribunal in O.A.No.571 of 1992 and based on the order of stay, the petitioner was reinstated in service.

3. It is at this stage, Mr.M.Elumalai, learned Government Advocate for the respondents submitted that based on the findings recorded by the Tribunal for Disciplinary Proceedings that the charge levelled against the petitioner stood proved, he was removed from service. Therefore, nothing survives in the matter.

4. Recording his statement, this writ petition stands dismissed. No costs.
