Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of certiorarified mandamus, to call for the records relating to the impugned order of the first respondent in R.No.126345/E4/S1/07, dated 25.8.2008 and quash the same and direct the first respondent to include the petitioner's name in the panel for promotion to the post of Superintendent for the year 2007-2008 issued by the first respondent in Proceedings R.No.70566/E4/2007/S1, dated 7.8.2007 above the third respondent and grant him all consequential benefits including promotion on par with the said junior. The learned counsel for the petitioner submitted that during the pendency of the writ petition, the petitioner has got promotion as Superintendent and the petitioner died two years ago. Hence, nothing survives for adjudication in this writ petition and he has also made an endorsement to that effect.
2. In the light of the above submission and endorsement made by the learned counsel for the petitioner, this writ petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
