ORDER
The writ petition has been filed seeking a mandamus to the first respondent to consider and dispose of the petitioner's representation dated 12.12.2025, by passing a reasoned order, after affording an opportunity of hearing to the petitioner.
2. The petitioner was the Member of the Goodwill Apartments Welfare Association and presently serving as Treasurer of the said Association. The third respondent herein is the President of said Association. When the third respondent had requested the petitioner to sign the 32nd Extraordinary General Body (AGM) Meeting, the petitioner had refused to sign the said document as he found the contents of it was incorrect and fabricated. However, the third respondent without making corrections, had submitted the incorrect proceedings to the first respondent. Aggrieved by which, the petitioner lodged a complaint on 17.03.2023 before the second respondent. The second respondent had conducted an enquiry and passed an order on 27.09.2023. During enquiry, the third respondent had admitted that the Minutes submitted by him was incorrect, despite which, the Minutes was allowed to remain pending on record.
3. Therefore, the petitioner made a representation to the first respondent on 21.02.2025, requesting to reject the Minutes of the General Body Meeting. However, the Minutes continue to remain on file. Hence, the petitioner had once again made a representation on 12.12.2025 to the first respondent. Since no action was taken, the petitioner is before this Court.
4. Heard the petitioner, Mr.Bipin Rajalingam S, who appeared before this Court Party-in-person and Ms.Akila Rajendran, learned Government Advocate, for the respondents 1 and 2 and perused the materials available on record.
5. Considering the limited scope of prayer sought for in this writ petition, this Court without going into the merits of the case, directs the first respondent to consider the representation of the petitioner dated 12.12.2025 and pass orders within a period of four weeks from the date of receipt of a copy of this order, after issuing notice and affording an opportunity of hearing to all concerned including the petitioner.
