Prayer : Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents to consider the petitioner's representation dated 18.05.2022 and cancel the patta No.958 in New Survey No.79/18, Patta No.959 in New Survey No.79/19 wrongly issued in favour of fourth respondent and her family members and issue patta in the name of the petitioner.

The Revenue Divisional Officer, Villupuram, is suo motu impleaded as fifth respondent in this writ petition.
2. Mr.S.Jayachandran, learned Government Advocate, takes notice for the impleaded fifth respondent.

This writ petition has been filed seeking issuance of a writ of mandamus directing the official respondents to consider the representation made by the petitioner on 18.05.2022 wherein the petitioner is seeking for cancellation of patta granted in the name of the fourth respondent and her family members with respect to the subject property.
4. Heard Ms.S.Suseela Devi, learned counsel for petitioner and Mr.S.Jayachandran, learned Government Advocate appearing for respondents 1 to 3 and 5.
5. The specific case of the petitioner is that the fourth respondent and her family members have no right or title over the subject property and are residing elsewhere. While so, patta has been issued in their name. Hence, the representation was made seeking to cancel the patta issued in the name of the fourth respondent and her family members. Since the same was not acted upon, the present writ petition has been filed before this Court. 3/6

Considering the facts and circumstances of the case and the materials placed before this Court and also taking note of the grievance expressed by the petitioner, there shall be a direction to the petitioner to submit a fresh representation before the impleaded fifth respondent seeking for cancellation of patta granted in favour of the fourth respondent and her family members. On receipt of the same, the impleaded fifth respondent shall issue notice to all the parties concerned and conduct an enquiry and pass orders within a period of twelve (12) weeks from the date of receipt of fresh representation from the petitioner.
This writ petition is disposed of with the above direction. No costs. 18.02.2025 Note: Registry is directed to carry out necessary amendment in all the concerned records.
