PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 1st respondent to consider the petitioner's representation dated 01.09.2004 thereby to take necessary action against 2nd respondent in the enforcement of settlement dated 15.03.2004 arrived under Section 18(1) of Industrial Disputes Act, 1947 between the petitioner and the 2nd respondent, within the time limit.

O R D E R
This Writ Petition has been filed by the Trade Union seeking for disposal of the representation dated 01.09.2004 given to the 1st respondent for taking necessary action against the 2nd respondent for enforcing settlement dated 15.03.2004. After lapse of 14 years, it would not be appropriate to direct the 1st respondent to consider the petitioner's representation dated 01.09.2004. Nevertheless, if the petitioner's grievance still subsists, it is always open to them to make a fresh representation.
2. In the light of the above observations, the petitioner is granted liberty to make a fresh representation, incase their grievances are still subsisting, to the 1st respondent, who inturn shall consider the said application as expeditiously as possible on its own merits and pass appropriate order in accordance with law.
3. With the above observations, the present Writ Petition stands closed.
