Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorari calling for records pertaining to the departmental proceedings initiated against the petitioner pursuant to the charge memo issued by the 3rd respondent in its Rc.No.5207/2002/A dated 25.03.2004. For Petitioner : Ms.M.F.Shabana For Respondents : Mr.C.Selvaraj Government Advocate.
ORDER
When the matter had come up on 13.09.2021, this Court noted the position that the writ petition was hit by laches insofar as the challenge is to a charge memo dated 25.03.2004, the writ petition having been filed in November 2008. This writ petition is thus liable to be dismissed on this ground itself. https://hcservices.ecourts.gov.in/hcservices/
2. In any event, Mr.Selvaraj, learned Government Advocate would state that since the petitioner has, in fact, been dismissed from service on 25.10.2010 on the basis of a subsequent charge memo, the present charge memo has not been proceeded with.
3. Thus, on the ground of laches as well as on the ground that nothing further survives in this writ petition, the same is dismissed. No costs.
