O R D E R

The petitioner, who was arrested and remanded to Judicial custody from on 20.11.2025 for the offences punishable under Sections 365, 376 & 506(ii) of IPC in Crime No.694 of 2010, seeks bail.

2. The allegation against the petitioner is that he was earlier arrested and released on bail. Thereafter, he was directed to appear before the Committal Court. However, the petitioner failed to appear and hence, Non-Bailable Warrant (NBW) was issued against him on 14.02.2013. The said NBW was executed only on 20.11.2025 and thereafter the petitioner has come forward with the present Criminal Original Petition.

3. The learned counsel for the petitioner submitted that the petitioner was not aware of the pendency of the case and he was residing in the address given by him. It is further submitted that though NBW was issued, the respondent police had not taken any effective steps to secure the custody of the petitioner all these years. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate (Crl.side) appearing for the respondent submitted that NBW had been issued against the petitioner as early as in the year 2013 and the same was executed only on 20.11.2025. It is further submitted that this Court had earlier directed the trial Court to send a report regarding whether the petitioner was notified about the committal proceedings and the Court before

which he was required to appear. Pursuant to the direction issued by this Court, a report has been received by way of a letter dated 09.02.2026.

5. The said report reveals that at the time of committal proceedings, the petitioner was duly notified about the transfer of the case to the trial Court. However, after the committal proceedings, the petitioner failed to appear before the Principal Judge, City Civil Court, Chennai and hence, NBW was issued against him on 24.01.2013. Thereafter, the case was transferred to the Mahila Court, Chennai on 04.12.2016. Despite being notified about the proceedings, the petitioner did not appear before the Court concerned.

6. Heard the learned counsel on either side and perused the materials available on record.

7. Considering the above facts and particularly the fact that the petitioner had failed to appear before the Court despite being notified about the committal proceedings and the issuance of NBW pending against him for a long period, this Court is not inclined to grant bail to the petitioner.

8. Accordingly, this Criminal Original Petition is dismissed. 10.02.2026 kmm
