PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus or any other appropriate writ, order or direction in the nature of a writ, calling for the records of the respondents 1 and 2 in connection with the impugned orders C.No.J1/PR136/93 and C.No.D2/AP11/2004 dated 24.01.2004 and 19.04.2004 respectively and quash the same and direct the respondents to grant all consequential service and monetary benefits and grant such other further relief.

O R D E R

The order under challenge in the present writ petition is to a punishment of reduction in pay by two stages for a period of 2 years, which reduction shall operate to postpone his future increment for 2 years also.

2.It is submitted by the learned Additional Government Pleader that pending the writ petition, the petitioner herein had reached the age of superannuation and all his retirement benefits have also been disbursed with. As such, no fruitful orders can be passed in the present writ petition. https://hcservices.ecourts.gov.in/hcservices/

3.The learned counsel for the petitioner would submit that the impugned orders are illegal and requires to be quashed and if done so, he would be entitled for being considered for promotion and the consequential monetary benefits. 4.I am unable to accept such a submission. The criteria for consideration for promotion is on various factors and just because the orders impugned, if set-aside, would automatically entitle him for promotion, is far-fetched.

5.In view of the fact that the petitioner has retired and has received all his pensionary benefits, no effective orders can be passed in the present writ petition.
