C.M.P.No.5805 of 2023 in Rev.Appl.SR.No.11731 of 2023 THE HON'BLE CHIEF JUSTICE and D.BHARATHA CHAKRAVARTHY, J.

Heard Mr.Surya Narayananan, learned counsel for the applicant, Mr.P.Muthukumar, learned State Government Pleader for respondents 1 to 3 and Ms.Sudharsana Sunder, learned counsel for respondent 4.

This application is filed to condone the delay of 305 days in filing the review application.

Learned counsel for respondent 4 submits that the order sought to be reviewed was challenged before the Apex Court. After the dismissal of the S.L.P., the present application is filed. The grounds raised in the review application were never raised before the Apex Court or in the writ appeal or in the writ petition. New case is sought to be built up by the review applicant.

The said issue would be considered while hearing the review application.

It appears that time was lost in prosecuting the S.L.P. For the reasons stated in the accompanying affidavit, the delay of 305 days in filing the review application is condoned.

Accordingly, the present application stands allowed and is disposed of. (S.V.G., CJ.) (D.B.C., J.) 23.11.2023 drm https://www.mhc.tn.gov.in/judis
