... Respondents This case came up for settlement before the National Lok Adalat. Both the parties are present. Mr.R.Mohan Babu, the learned counsel for the Appellant, Mr.Suresh Srinivasan, learned counsel for the second respondent Insurance Company and Mr.Saravana Bhavan Assistant Vice President of the 2nd respondent Insurance Company are present. Notice dispensed with for the first respondent as he remained ex-parte before the Tribunal. Upon mutual discussion, negotiation, mediation and conciliation between both the parties, they arrived at a compromise to settle the matter as follows:- TERMS OF SETTLEMENT The present appeal arises against the order passed by the Motor Accidents Claims Tribunal, VI Court of Small Causes, Chennai in MCOP No.2227 of 2020 dated 13.03.2024. It is a case of injury. The appellant / claimant had claimed a sum of Rs.7,50,000/-. The award was for a sum of Rs.1,30,000/- together with interest. 2. Pending the appeal, the parties have compromised the matter. Both the appellant, Mr.R.Mohan Babu, learned counsel for the appellant, Mr.Saravana Bhavan, Assistant Vice President of the 2nd respondent Insurance Company and Mr.Suresh Srinivasan, learned counsel for the second respondent are present. They have agreed to settle the matter for a payment of Rs.2,00,000/- (Rupees Two Lakhs only) in full quit. They stand by the settlement arrived at.
3. The Civil Miscellaneous Appeal is disposed of in terms of the settlement as aforesaid. The amount awarded by this settlement is directed to be deposited to the credit of MCOP No.2227 of 2020 on the file of the Motor Accidents Claims Tribunal, VI Court of Small Causes, Chennai within a period of four weeks from the date of receipt of a copy of this order. On such deposit, the appellant will be entitled to withdraw the same. The CMA is settled accordingly.
