ORDER

The petitioner has filed this writ petition seeking for a direction to the respondent / the General Manager, Tamil Nadu State Transport Corporation (Coimbatore) Limited, Coimbatore, to select and appoint him in the post of Driver under the respondent Corporation.

2. When the matter is taken up, learned standing counsel for the respondent Corporation, by filing a counter affidavit, urged this Court to dismiss the writ petitioner on the ground of over-age by the petitioner.

3. This Court is also able to see from the available materials produced before this Court that at the time of filing of the writ petition in the year 2009, the petitioner was aged about 43 years, therefore, in view of passage of 10 long years, the petitioner is over-aged to consider him for the post of Driver under the respondent Corporation as he is now admittedly aged about 53 years.

4. Thus, in view of the above, as the petitioner is aged about 53 years now, his prayer to consider him for appointment to the post of Driver under the respondent Corporation cannot be considered on the ground of over-age. Therefore, on this count, the writ petition is dismissed. No Costs.
