O R D E R
The present Writ Petition (Criminal) has been filed seeking a direction to the third respondent not to interfere in the civil dispute existing between the petitioner and respondent 4 and 5, by considering the representation of the petitioner dated 30.12.2025. Mr.S.Santhosh, learned Government Advocate (Criminal Side), takes notice on behalf of respondents 1 to 3. In view of the consent expressed by the learned counsel on either side, this Writ Petition (Criminal) is taken up for final disposal at the admission stage itself. Notice to respondents 4 & 5 is dispensed with inasmuch as no order prejudicial to their interest is passed. Learned counsel appearing for the petitioner submitted that respondents 4 & 5 caused disturbance to the petitioner and attempted to encroach the property owned by the petitioner's son. He further submitted that a civil suit in O.S.No.98 of 2025, is also pending on the file of the District Munsif Court at Thiruvottiyur. However, in the meantime, the third respondent, by summoning the petitioner, threatened him in support of the 2/5
private respondents and interfered in the civil dispute. Therefore, the petitioner sent a representation to respondents 1 and 2 against the act of the third respondent on 30.12.2025. Since no action has been taken on the petitioner's representation, the present petition has been filed. 5.
Learned Government Advocate (Criminal Side) appearing for respondents 1 to 3 submitted that only on the basis of the complaint given by the fourth respondent, the third respondent summoned the petitioner and conducted an enquiry and as the dispute between the parties was found to be civil in nature, the third respondent closed the complaint and directed the parties to approach the civil court. He further submitted that the respondent Police would not interfere in the civil dispute. 6.
In view of the above, this Court directs the third respondent police not to interfere with the civil dispute between the petitioner and the private respondents. Accordingly, this Writ Petition (Criminal) stands disposed of. No costs.
