PRAYER :

Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, calling for the records in connection with impugned order in O.Mu.No.9872/2006(A5) dated 15.09.2006 passed by second respondent herein and quash the same and consequently direct the second respondent herein to issue adangal extract to the petitioner lands in patta nos.606, 612, 617 and 621 and further direct the third respondent to pay Rs.10,00,000/- as compensation to the petitioner.

ORDER

This writ petition has been filed to quash the order in O.Mu.No.9872/2006(A5) dated 15.09.2006 passed by the second respondent, rejecting the claim of the petitioner seeking Adangal extract relating to the patta Nos.606, 612, 617 and 621 of the lands in Thandarai Village, Denkanikottai Taluk, and for consequential reliefs.

However, today when the matter was taken up for consideration, the learned counsel for the petitioner submitted that due to efflux of time, it would suffice, if the petitioner is granted liberty to submit a fresh application to the respondent authorities for the relief sought for herein, for which, the learned Additional Government Pleader appearing for the respondent authorities has no serious objection.

3. Considering the facts and circumstances of the case and having regard to the submissions made by the learned counsel on either side, this Court disposes of this writ petition, granting liberty to the petitioner to submit a fresh application seeking Adangal extract relating to his lands, to the respondent authorities, within a period of two weeks from the date of receipt of a copy of this order. On such submission, the respondent authorities shall consider the same and pass appropriate orders, on merits and in accordance with law, within a period of two weeks, thereafter. No costs. Consequently, connected Miscellaneous Petition is closed.
