The instant writ petition has been filed challenging order dated 19.01.2022 passed by the first respondent.

The learned counsel for the petitioner would submit that the petitioner had given a complaint against the second respondent, alleging that he had issued a false No Objection Certificate to the third respondent, who is none other than the petitioner's father. According to the petitioner, though his mother died on 01.11.2014, his father, the third respondent, married the fourth respondent and that the fourth respondent was not a divorcee and had a subsisting marriage at the time of marrying the third respondent. It is the submission of the learned counsel for the petitioner that there was a duty cast upon the second respondent to verify the divorce order granted by the jurisdictional Court. However, the second respondent issued a No Objection Certificate based on an agreement submitted by the fourth respondent. The authority, vide the impugned order, did not take into consideration the material aspects and passed an order contrary to the factual position. 2/5

However, the said contention was strongly objected to by the learned Government Advocate appearing for the fifth respondent, who would invite the attention of this Court to the submission of the decree of divorce in O.S. No. 165 of 2011, wherein the fourth respondent obtained a decree of divorce, vide order dated 07.02.2012.

4. Though the petitioner's counsel would challenge such a submission, under the writ jurisdiction, this Court cannot go into the factual position of the matter. On perusing the order of the authority, this Court does not find any perversity.

5. It is a well-settled principle of law that the possibility of an alternative view cannot be a ground to interfere with the order of the authorities concerned while exercising the power of judicial review. Hence, this Court does not find any merit in the instant Writ Petition. 3/5
