Respondents/Defendants This application has been filed under Order XIV Rule 8 of the OS Rules read with Order XXVI Rule 13 and 14 of C.P.C., to appoint an Advocate/Commissioner to inspect the schedule properties and to divide the properties into 4 equal shares by metes and bounds and to allot 1/4th share to the applicant and submit the report to this Hon'ble Court and after enquiry why this Hon'ble Court may not be pleased to pass a Final Decree on the basis of the report of the Advocate/Commissioner. 1/4

ORDER

Advocate Commissioner has filed a memo stating that the Commissioner Warrant issued to her to inspect Item I and III of Schedule B property and there is yet another property shown as Item II, which is not included in the warrant issued to her. However, while inspecting Item I and III properties, by consent of both the parties Item II also inspected and therefore, she may be permitted to file a report in respect of all the three items of properties described under Schedule B.

2. The learned counsels appearing for the respective parties acknowledged the inspection of the Advocate Commissioner in respect of Item II along with I and III on 10.12.2024(yesterday). 2/4
