O R D E R
This criminal revision petition has been filed by the petitioner seeking to set aside the order dated 11.06.2018 passed in Crl.M.P.No.3628 of 2017 in D.V.C.No.150 of 2017, by the learned Additional Mahila Court, Egmore, at Allikulam Complex, Chennai.
2.It is stated that the petitioner already filed a domestic Violence case before the lower Court in D.V.C.No.150 of 2017 and in that main case, he filed the interim application (Crl.M.P.No.3628 of 2017) for returning of Seethana property. The learned Additional Mahila Judge, dismissed the petition, on the ground that though the petitioner/wife left the matrimonial home in the year 2003, the interim application has been filed only in the year 2014, ie., after a lapse of 11 years and that there is no proper explanation for delay in filing the application. Aggrieved over the dismissal of the interim application, the petitioner/wife has come forward with the present revision.
3.When the matter is taken up today, though the present revision has been filed for a larger relief, the learned counsel for the petitioner made a request that if a direction is given https://hcservices.ecourts.gov.in/hcservices/
to the Court below to dispose of the main case within a time frame, it would suffice.
4.Considering the limited prayer sought for the learned counsel for the petitioner, without going into the merits of the case, this Court incline to direct the court below to dispose of the main case in D.V.C.No.150 of 2017, on merits and in accordance with law, within a period of six months from the date of receipt of a copy of this order.
When the above direction, this criminal revision petition is disposed of.
