PRAYER : Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to direct the respondent police to complete the investigation and to file the final report in Crime No.565 of 2019.

O R D E R

This petition has been filed seeking for a direction to the respondent police to file a final report in Crime No.565 of 2019.

2. Even on an earlier occasion, the petitioner had approached this Court seeking for a similar prayer in Crl.O.P No.20656 of 2020 and it was reported before this Court that the final report has already been filed before the Judicial Magistrate Thiruthani. Recording the same, the criminal original petition was closed on 23.12.2020.

3. The petitioner, thereafter filed a copy application before the Court below and sought for the final report and the same was returned with an endorsement that the charge sheet has not been filed. Aggrieved by the same, the present petition has been filed before this Court.

4. The learned Additional Public Prosecutor circulated the copy of the final report that has already been filed before the Judicial Magistrate, Thiruthani in F.R. No.1216 of https://hcservices.ecourts.gov.in/hcservices/ Page numbers

2019 on 22.11.2019. The learned counsel submitted that the Court below is yet to take cognizance of the final report and that is the reason why the copy has not been furnished to the petitioner when a copy application was filed by the petitioner.

5. In view of the above, there shall be a direction to the Judicial Magistrate, Thiruthani to take cognizance of the final report within a period of four weeks from the date of receipt of a copy of this order and proceed further in accordance with law.

6. This Criminal Original Petition is disposed of, with the above direction.
