ORDER
The petitioner, who was arrested and remanded to judicial custody on 26.09.2025, for the alleged offence punishable under Sections 5(1), 5(j)(ii) r/w. 6 of POCSO Act 2012 in Crime No.46 of 2025 on the file of the respondent
police, seeks bail.
2. The allegation against the petitioner is that the petitioner is running a button company and in which the victim girl is aged about of 15 years employed and on the pretext of loving her committed aggravated penetrative sexual assault and also kidnapped her to Kanniyakumari and subsequently it revealed that the victim girl is also became pregnant. It was reported to the family members of the victim and the case was registered and the petitioner was arrested.
3. Learned counsel appearing for the petitioner submitted that the petitioner is in custody from 26.09.2025 and ready to cooperate with the trial and in this case the final report is also filed. Hence, he prayed for grant of bail to the petitioner.
4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner herein is a married person aged about 28 years and the victim girl is aged about 15 years after luring her by stating that he is loving her and taken her to various places and committed aggravated penetrative sexual assault. Hence, the petitioner has been arrested and the final report was also filed and the same is pending in S.C.No.265 of 2025. Hence, he opposed for grant of bail to the petitioner.
5.I have also gone through the statement recorded and other connected materials which revealed that the petitioner lured the victim aged about 15 years and committed aggravated penetrative sexual assault and subsequently the victim girl became pregnant, now the foetus was also aborted. Considering the nature of the allegations and though it is stated that final report was also filed, the manner in which the petitioner committed the offence, this court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
