Comp.A.No.259 of 2018 in C.P.No.255 of 2014 KRISHNAN RAMASAMY, J., Today, when the matter is taken up for hearing, learned Official Liquidator submitted that the Respondent Company is under the liquidation process before the National Company Law Tribunal (NCLT) and hence seeks permission of this Court to withdraw this Application with liberty to file a claim petition before the Resolution Professional of the Respondent Company. She has also made the following endorsement to that effect:

"Respondent Company undergoing CIRP and Insolvency and Resolution Professional appointed by NCLT.

Application may be allowed to be withdrawn with liberty to approach the Hon'ble Court if deemed necessary."

2. Recording the submission and endorsement made by the learned counsel for the Applicant, this Application is dismissed as withdrawn with liberty as prayed for. However, the learned Official Liquidator shall file claim statement before the Resolution Professional, within a period of eight weeks from the date of receipt of a copy of this order.
