The complaint under the Essential Commodities Act, 1955 sought to be quashed by the employer on the ground that under the Essential Commodities Act employer cannot be prosecuted for violation of provision under Section 7(1)(a)(ii) of Essential Commodities Act, 1955. 2.The learned Additional Public Prosecutor submitted that the contention of the petitioner will be considered by the Investigation Officer and appropriate decision will be taken before filing final report and the learned Additional Public Prosecutor seeks sixty days time to complete. 3.There shall be a direction to the learned Additional Public Prosecutor to file the final report within sixty days. If the petitioner still aggrieved by the final report, liberty is given to the petitioner to approach this Court for appropriate remedy.
