O R D E R

This petition has been filed seeking for contempt for non compliance of the order of this Court passed in Crl.O.P.No.9347 of 2022 dated 26.04.2022 in respect of filing of final report, whereby, this Court had directed the respondent herein to file the final report in Crime No.542 of 2021 within a period of four months from the date of receipt of a copy of the order.

When the matter is taken up for hearing today, the learned Government Advocate (Crl.Side) submitted that pursuant to the order passed by this Court on 26.04.2022, the investigation in Crime No.541 of 2021 has been completed and the final report has also been filed before the learned Judicial Magistrate-IV, Vellore on 14.11.2022. He further submitted that when the respondent had attempted to serve the copy of the final report on the petitioner, she had refused to accept the same.

3. In reply, the learned counsel for the petitioner submitted that he was served with the copy of the final report only on 15.06.2023 by speed post.

4. Recording the submissions of the learned Government Advocate (Crl.Side), this Court is of the opinion that the respondent had completed the investigation and also filed the final report and thereby, this Court is inclined to close the Contempt Petition.

5. Accordingly, this Contempt Petition is closed. However, the petitioner is granted the liberty to challenge the final report, by way of filing the protest petition.
