This Criminal Appeal has been filed to set aside the order dated 20.10.2010 in C.C.No.55 of 2008 by the learned Judicial Magistrate No-III, Coimbatore.
Today, when the matter is taken up for hearing there is no representation on either side. On 08.04.2019 this Court passed an order that the appellant should take substitute of service in any one of the publication of Tamil daily newspaper but the same was not executed by the appellant. Since, it is a private complaint, the appellant has not taken any step for substitute of service, despite order of this Court dated 08.04.2019. This Court finds that the appellant is not interested to proceed with the present appeal. Therefore, the Criminal Appeal is dismissed for non-prosecution.
