Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorari Mandamus to call for the records and quash the same of the recruitment of Senior Lecturer in DTERT/DIET 20102011 provisional list of candidates after certificate verification dated 28.04.2015 in Sub Code 11S DO8 History Roll No.IISDO8290093 name C.Alamelu the seventh respondent herein from the fresh round of Certificate verification of the Tentative Provisional List of candidates on 10.04.2015 by the second respondent herein after proper verification of the 5 years' experience certificate submitted by the above said C.Alamelu and consequently to declare the petitioner as the next eligible candidate the fresh round of certificate verification and appoint him to the post of Senior Lecturer in District Institute of Education and Training (DIET) on the basis of the petitioner's representation dated 04.04.2015.

The petitioner has filed this writ petition seeking issuance of Writ of Certiorari Mandamus to call for the records and to quash the recruitment of Senior Lecturer in DTERT/DIET 2010-2011 provisional list of candidates after certificate verification dated 28.04.2015 in Sub Code 11S DO8 History Roll No.IISDO8290093 name C.Alamelu the seventh respondent from the fresh round of certificate verification of the Tentative Provisional List of candidates on 10.04.2015 by the second respondent after proper verification of the 5 years' experience certificate submitted by the above said C.Alamelu and consequently to declare the petitioner as the next eligible candidate the fresh round of certificate verification and appoint him to the post of Senior Lecturer in District Institute of Education and Training (DIET) on the basis of the petitioner's representation dated 04.04.2015. 2.The case of the petitioner is that on 31.12.2011, the second 3/7
respondent made advertisement in the leading Tamil News Daily inviting applications for the post of Senior Lecturer for District Institute of Education and Training under the Directorate of Teacher Education Research and Training and the petitioner applied for the same and also appeared for the written examination on 04.03.2012. The result was published on 04.06.2012 and the petitioner secured 72 marks out of 150 marks, however, after selection process, the seventh respondent was selected and appointed as Senior Lecturer in the District Institute of Education and Training. 3.According to the petitioner, the experience certificate produced by the seventh respondent is fabricated one and hence, he made representation to the respondents 1 to 3 on 04.04.2015 to cancel her name from the tentative provisional list and to consider his name since he is the next eligible person, however, the seventh respondent was appointed as Senior Lecturer. Hence, this writ petition.
4.The learned counsel for the petitioner submitted that though the seventh respondent secured two marks more than the petitioner, the experience certificate produced by her is not genuine. 4/7
5.The learned Special Government Pleader submitted that after receipt of the representation from the petitioner, the experience certificate produced by the seventh respondent was scrutinized by the respondents 2 and 3 and it was found to be genuine. 6.Heard both sides and perused the materials available on record.
7.It is the specific contention of the learned Special Government Pleader that after receipt of the representation from the petitioner, the certificate produced by the seventh respondent was subjected to scrutiny and it was found that the certificate was genuine and the appointment was in accordance with law and therefore this Court in exercise of the writ jurisdiction is not inclined to grant the relief sought by the petitioner. 8.The writ petition is accordingly dismissed. No costs.
Consequently, connected miscellaneous petition is closed. 09.01.2023 pri 5/7
