Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 1st and 2nd respondent to measure the boundaries of petitioner's lands to an extent of 2 Ares and 55 cents comprised in S.No.61/1, 63/1, 63/2 64/68/1 and 70 situated at Vadakarai Village, Madhavaram Taluk, Thiruvallur District and further direct the 3rd respondent to give adequate police protection for same.

O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondents 1 and 2 to measure the boundaries of petitioner's lands to an extent of 2 Ares and 55 cents comprised in S.No.61/1, 63/1, 63/2 64/68/1 and 70 situated at Vadakarai Village, Madhavaram Taluk, Thiruvallur District and to further direct the third respondent to give adequate police protection for same.

2.It is represented by the learned Government Advocate that during the pendancy of this writ petition, Madhavaram Taluk was bifurcated and at present Vadakarai Village comes under Ponneri Taluk.

3.In view of the submission made by the learned Government Advocate, the relief sought for in this writ petition cannot be granted. However, liberty is granted to the petitioner to make fresh application before the Tahsildar, Ponneri, within a period of four weeks from the date of receipt of a copy of this order. If any such application is made by the petitioner, the concerned Tahsildar shall consider the same and pass appropriate orders, as expeditiously as possible.

4.The writ petition is accordingly disposed of. No costs. Consequently, connected miscellaneous petition, if any, is closed.
