2024-02-06Honourable Mr Justice C.V. Karthikeyan2 pages

Crl.O.P.No.2188 of 2024 Crl.O.P.No.2188 of 2024 C.V.KARTHIKEYAN,J.

The petitioner who was arrested and remanded to judicial custody on 06.10.2023 for the offences punishable under Sections 5(m), 6, 9(m), 10 of POCSO Act, 2012 in Crime No.20 of 2023 on the file of the respondent Police, seeks bail.

2.It is the case of the prosecution that the petitioner had committed the offence on two separate victim children and consequent to which, a complaint was lodged and FIR had been registered. 3.The learned counsel for the petitioner stated that there was a civil dispute between the petitioner and the defacto complainant and therefore, a false complaint has been given. It is also stated that on completion of investigation, final report had been filed and the same has been taken cognizance as Spl.S.C.No.118 of 2023 before the POCSO Court, Villupuram. 4.Since the charges have not been framed, at this stage, I am not inclined to grant bail to the petitioner.

5.Hence, this Criminal Original Petition is dismissed. 06.02.2024 vkr https://www.mhc.tn.gov.in/judis 1/2
