Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to disburse the leave encashment benefits to the petitioner which he is entitled for the periods of 02/2019 & 02/2020 with interest at the rate of 8% per annum from the said date of entitlement to till the date of actual disbursement within a time limit to be stipulated by this Court.

ORDER

This Writ Petition has been filed in the nature of a Mandamus seeking a direction to the respondents to disburse the leave encashment benefits for the period between February 2019 and February 2020 together with interest at 8% per annum.

2.In the affidavit filed in support of the writ petition, it had been stated that the petitioner had retired from service on attaining the age of superannuation on 31.10.2022. However, the leave encashment for the period between February 2019 and February 2020 to a sum of Rs.29,400/- and Rs.32,371/- had not been immediately paid to him. The petitioner had given a representation in this regard. Now, owing to the belated payment, the petitioner seeks interest also to be paid to him. 3.Taking all the factors into consideration, a direction is given to the

respondents to disburse the amount with interest at 6% per annum from the date of entitlement namely, a sum of Rs.29,400/- from February 2019 and a sum of Rs.32,371/- from February 2020 till the date of disbursal. The amount which is paid should bear interest at 6% per annum. It would only be in the interest of the respondents to pay the amount immediately to the petitioner, as they would suffer with payment of additional interest. The entire procedure be completed within a period of six weeks from the date of receipt of a copy of this order.

4.With the above observations, this Writ Petition stands disposed of. No costs.
