ORDER

This Writ Petition has been filed challenging the orders passed by the 1st respondent dated 01.06.2023 and 11.01.2024, thereby the 1st respondent directed the 'A' and 'B' Parties to maintain separate keys for the same lock to conduct Pooja during Full Moon Days and Dark Moon days in Arulmigu Sri Mahaliamman Temple, Thottampalayam Village, Sathyamangalam Taluk administered by the Hindu Religious and Charitable Endowment Department.

2. Heard both sides and perused the entire documents available on record.

3. The petitioner belongs to 'A' party and he challenges the orders passed by the 1st respondent only on the ground that he is not able to do poojas during Full Moon Days and Dark Moon Days, since the respondents 4 to 10 are disturbing his day today activities.

4. A perusal of the orders impugned in this Writ Petition, clearly revealed that both 'A' and 'B' parties are permitted to conduct poojas during Full Moon Days and Dark Moon days in Arulmigu Sri Mahaliamman Temple, Thottampalayam Village, Sathyamangalam Taluk and they are not permitted

to do other activities in the said temple, since in respect of other rights, already applications are pending before the Joint Commissioner, H.R. & C.E. Department, Erode. It is to be noted that both the orders dated 01.06.2023 and 11.01.2024 passed by the 1st respondent are valid till the orders are passed in the applications pending before the Joint Commissioner, H.R. & C.E., Department, Erode / 3rd respondent. However, even till today, the applications are pending on the file of the Joint Commissioner, H.R. & C.E., Department, Erode / 3rd respondent without passing any orders.

In view of the above, this Court finds no infirmity or illegality in the orders passed by the 1st respondent, since the orders are passed by the 1st respondent only in order to maintain law and order issues. Therefore, the 3rd respondent is directed to pass orders on the applications filed by the petitioner and the counter parties within a period of three months from the date of receipt of a copy of order.

Accordingly, the present Writ Petition is dismissed. Consequently, connected miscellaneous petitions are closed. No costs. 02-06-2026 Index: Yes/No Speaking/Non-speaking order ssd
