This petition has been filed to condone the delay of 73 days in filing the Civil Miscellaneous Appeal.

2. Heard the learned counsel for the petitioner and the learned counsel for the 2nd respondent. Though notice was served, there is no representation for the 1st respondent.

3. Learned counsel for the 2nd respondent has no serious objection in allowing the petition.

4. Considering the submissions made by the learned counsel for the petitioner, this Court is of the view that the delay may be condoned, however, on payment of cost. Accordingly, the delay is condoned on payment of cost of Rs.500/- (Rupees Five Hundred only) by the petitioner to the Madras High Court Legal Aid Services Authority, Chennai, within a period of one week from today. If the cost is paid on or before 14.06.2023 and the affidavit of service is filed, this Petition stands allowed and the Registry is directed to number the main Appeal.
