(Order of the Court was made by T.RAJA,J.) The Civil Miscellaneous Petition has been filed to amend the cause title.

2.Learned counsel appearing for the petitioner submitted that since Mr.K.Vijayan, the Power of Attorney herein has passed away on 20.04.2013, this petition has been filed to amend the cause title. In support of his submission, learned counsel for the petitioner has also produced a death certificate issued on 25.04.2013 by the Sub Registrar of Birth and Death, Kozhikode Corporation. 3.Heard Mr.John Zachariah, learned counsel appearing for the petitioner, M.A.Ansar, learned Government Advocate, who takes notice for R1, R2 & R4 and Mr.S.Prabhu, learned Additional Government Pleader, who takes notice for the third respondent.

4.A perusal of the above death certificate issued by the Sub Registrar of Birth and Death, Kozhikode Corporation shows that Mr.K.Vijayan, the Power of Attorney herein died on 20.04.2013. Therefore, we are inclined to accept the cause 1/2
