Petition filed under Article 226 of the Constitution of India praying to issue a writ of certiorarified mandamus after calling for the records of the Circular letter bearing Cir. DO. PER. No.82 dated 10.12.2003 in sofar as fixing the upper age limit of 50 years for being considered for promotion to the post JMG Scale I in the seniority channel on the fiile of the second respondent and also the consequential order dated 21.05.2004 bearing No.PER: PS:793 and quash the same and consequently issue directions directing the respondents to reduce the minimum age limit to 40 years for considering a S.C./S.T. For promotion from the post of Clerk to JMGS-1.

ORDER

The petitioners have come to this Court challenging the Circular bearing Cir. DO. PER. No.82 dated 10.12.2003 and also the consequential order dated 21.05.2004 bearing No.PER: PS:793 and seeking a direction to the respondents to reduce the minimum age limit to 40 years for considering S.C./S.T. for promotion from the post of Clerk to JMGS-1.

2.When the matter is taken up for hearing, learned counsel appearing for the petitioners fairly submitted that after getting promotion in the year 2015, the second petitioner has been retired from service. Learned counsel for the petitioners sought liberty to the second petitioner to work out his remedy. 3.Since the second petitioner has been retired from service after getting promotion in the year 2015, nothing survives for further adjudication in the petition. Accordingly, the writ petition stands dismissed. Consequently, connected M.P. is closed. Liberty is given to the second petitioner to work out his remedy in the manner known to law. No costs.
