Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, calling for the records pertaining to issuance of patta bearing No.989 for Natham survey number 280/5, Old S.No.106/4 part of Ammapalayam Revenue Village, Perambalur Taluk and District, issued in the name of two dead persons, namely Late Periyasamy and Late Nallusamy, on 16.03.2024 by the fourth respondent and quash the same and restore the patta 989, as stand on 30.08.1994 in the name of Periyasamy, Nallusamy, Nagammal and Maruthamuthu and conduct the enquiry with all interested persons and their entitlement as per the Tamilnadu Patta Pass Act,1983, pass appropriate orders considering the revenue records and after enquiring the petitioner.

ORDER

This Writ Petition has been filed challenging the patta that has been issued in the name of Periyasamy and Nallusamy, who are dead and gone in patta 2/6

No.989 pertaining to the subject property and for a consequential direction to conduct a proper enquiry and to issue patta in the name of all the legal representatives of Periyasamy, Nallusamy, Nagammal and Maruthamuthu. 2.Heard Mr.P.Thiagarajan, the learned counsel appearing on behalf of the petitioner and Mr.A.Selvendran, the learned Special Government Pleader appearing for the respondents 1 to 5.

3.When the matter was taken up for hearing today, the learned Special Government Pleader based on the written instructions received from the 4th respondent submitted that the representation made by the petitioner for conducting a fresh enquiry for issuance of patta to all the legal heirs belonging to the above said four persons is under way and the enquiry has been fixed on 17.02.2025 on which date all the concerned persons can produce the relevant documents which will be considered and appropriate orders will be passed. 4.In light of the above submission, it will suffice if a direction is issued to the petitioner and others who are seeking for patta to be present before the 4th 3/6

respondent on 17.02.2025 for the enquiry along with all the relevant documents. The enquiry shall be completed and a decision shall be taken by passing appropriate orders within a period of six (6) weeks thereafter. 5.This writ petition is disposed of with the above directions.
