Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition that the petitioner is directed to deposit original title deeds of immovable property worth 30 lakhs (Rupees Thirty Lakhs Only) either in the name of the petitioner or his relatives/ friends to the credit of the Crime No.01 of 2020 made in Crl.O.P.No.31 of 2021 dated 07.01.2021.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. SWAMI SUBRAMANIAN, Advocate for the petitioner, and of MR. C.IYYAPPARAJ, Additional Public Prosecutor, on behalf of the Respondent, the court made the following order:- Learned counsel for the petitioner would submit that the petitioner was granted anticipatory bail by the order of this Court dated 07.01.2021 in Crl.O.P.No,31 of 2021 on condition to deposit original title deeds of immovable property worth Rs.30 Lakhs (Rupees Thirty Lakhs only) standing either in the name of the petitioner or his relatives / friends to the credit of Crime No.01 of 2020.

2.Learned counsel would further submit that despite the best efforts taken by the petitioner, the petitioner is unable to arrange for the original title deeds of immovable property worth Rs.30 Lakhs belonging to him or his relatives/friends. He would further submit that five properties belonging to the petitioner have already been attached by the Co-operative Sub Registrar / Sales Officer and Field Officer, Muthupettai, Thiruvarur District. He would further submit that even during the pendency of the case, the petitioner had deposited Rs.41 Lakhs to the account of the Society and that the petitioner's entire terminal benefits have been attached by the Society and the petitioner has no other means to comply with the conditions imposed by this court in paragraph No.8. Accordingly prays for appropriate orders.

3.Taking into consideration that the terminal benefits of the petitioner has already been attached by the Society, this court is inclined to modify the condition imposed in paragraph No.8 of the order alone dated 07.01.2021 in Crl.O.P.No.31 of 2021. The other conditions imposed by this court in Crl.O,P.No.31 of 2021 dated 07.01.2021 shall remain unaltered.

4.A further period of two weeks is extended for executing sureties.
