ORDER

This Writ Petition is filed for directing the 2nd respondent to conduct an enquiry on the basis of the letter of the 1st respondent dated 28.12.2024 and by considering the petitioner's representation dated 23.12.2024.

2. Heard the learned counsel for the petitioner and the learned Government Advocate appearing on behalf of the respondents 1 to 3 and perused the material records of the case.

3. On perusal of the affidavit filed in support of the Writ Petition as well as the representation, it is the contention of the petitioner that the 4th respondent being the Dharmakartha and the respondents 4 to 8 who are mis-managing the

affairs of the temple and are also not properly submitting the accounts.

4. In that view of the matter, the petitioner ought to have made an appropriate application for enquiry before the authorities under the Tamil Nadu Hindu Religious and Charitable Endowments Act, 1959 and the respondents 1 and 2 are not the competent authorities to go into the allegations made in the complaint.

5. Therefore, keeping open the petitioner's liberty to make a complaint before the appropriate authority viz., the jurisdictional Assistant Commissioner, HR & CE Department, this Writ Petition stands disposed of. No costs. 06.02.2025 : No Jer
