ORDER

The petitioner, who was arrested and remanded to judicial custody on 10.12.2025, for the offences punishable under Sections 326, 303(2) of BNS and 21(1) of Mines and Minerals (Development & Regulation) Act, 1957 in Crime No. 768 of 2025 on the file of respondent police seeks bail. 1/4

2. The allegation against the petitioner is that the petitioner joined hands with other accused quarried illegally three bags of river sand from Balaru and the same was transported by using two wheeler without any valid permission from the government. Hence, the case has been registered and the petitioner has been arrested on 10.12.2025.

3. The learned counsel for the petitioner submitted that petitioner has not committed any offences and he has been falsely implicated in this case and he was arrested and remanded to judicial custody from 10.12.2025 and now, he is ready to abide by any condition imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is having nine previous cases out of four cases are similar in nature, and therefore, he opposed for grant of bail to the petitioner. 2/4

5.Considering the fact that though the properties have been recovered from the petitioner; that the petitioner is having nine previous cases out of four cases are similar in nature; and if bail is granted to the petitioner he would damage ecology and river bed, hence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition shall stands dismissed.
