(Order of the Court made by M.DURAISWAMY, J.) The petitioner filed a Writ Petition in W.P.No.30121 of 2018 to issue Writ of mandamus directing the respondents to pass an order on the proceedings dated 12.03.2018 expeditiously. This Court, taking into consideration the submission made by the learned Government Pleader to the effect that the respondents would pass appropriate orders within eight weeks time, disposed of the Writ Petition. Since the respondents failed to pass orders in the proceedings dated 12.03.2018, the Writ Petitioner has filed the above Contempt Petition seeking to punish the respondents for the disobedience of the order passed in the Writ Petition. 2.When the Contempt Petition is taken up for hearing, Mr.M.Elumalai, learned Additional Government Pleader appearing for the respondents submitted that the 3rd respondent has filed a report dated 20.03.2021 stating that there is no encroachment in the land in question. Further, the learned Additional Government Pleader submitted that the Writ Page 2 / 4
Petitioner is a former Village Administrative Officer and knowing fully well that there is no encroachment in the land, has filed the Writ Petition. 3.In view of the submission made by the learned Additional Government Pleader to the effect that there is no encroachment in the land in question and the stand of the Tahsildar to that effect, we do not find any reason to keep the Contempt Petition pending. Accordingly, the Contempt Petition is closed. However, in the event of any subsequent encroachment made in the land in question, it is open to the Writ Petitioner to file an appropriate petition seeking for appropriate relief before the appropriate Forum.
